Can non-residents claim tax credits in the UK?

You are entitled to claim personal tax allowances if you are a UK, or European Economic Area (EEA) national. The personal allowance of £12,570 in 2024/25 can often cover any UK sources of income that a taxpayer may have.
Non-residents in the UK often need to fully reconcile their tax position by filing a UK tax return. If you’re not sure if you need to file a UK tax return, Taxback can check your circumstances and clarify this. We can also check if you’ve overpaid tax and you’re due to claim a UK tax refund.

Am I a resident or non-resident for tax in the UK?

As residents and non-residents are treated very differently for tax, it is very important to correctly determine your tax residency status while living and working in the UK.
In short, you will be considered a UK tax resident if you spend 183 days or more in the UK in a tax year.

The following factors can also affect your UK tax residence status:

  • The location of your home and if you have a home in the UK
  • If you’re working in the UK or abroad
  • If you have family and other ties to the UK
  • How long you spend in the UK compared with time spent in other countries
  • Whether you have been resident in the UK in previous tax years

The average UK tax refund is £963

What is the difference between being a resident or non-resident for tax purposes?

Broadly speaking, if you are a UK resident, you are taxable on your worldwide income in the UK for the period you are resident.

Meanwhile, if you are considered non-resident, your UK income tax liability is normally restricted to earnings from employment carried on in the UK or on UK source personal income, such as interest on UK bank accounts, UK dividends and rental income from UK properties.

UK tax can be a complex area to navigate and there are many rules on whether you are deemed ‘resident’ or not.

When you register with Taxback, a member of our UK tax team will help you to correctly determine your tax residency status and whether you’re due a tax refund.
